Terms of Service

Plain-language summary first: BidYourStartup sells one thing — the #1 spot on this website for $1.99. Your listing goes up instantly, and it comes down the moment the next person pays $1.99. That is the whole product, and these terms are the whole deal.

1. What BidYourStartup is

  1. BidYourStartup (“we”, “us”) operates a paid-placement marketplace at bidyourstartup.com (domain registration pending). Anyone may pay a fixed, non-negotiable price of $1.99 to place their startup’s name, link, tagline, and optional logo in the #1 spot on the homepage.
  2. The #1 spot always belongs to the most recent purchaser. When someone else pays $1.99, your listing moves down and a live counter shows how long your reign at #1 lasted.
  3. Time spent at #1 accumulates toward honorific titles — Startup of the Day, Week, and Month — computed mechanically from recorded time at #1. These crowns are entertainment: they carry no cash value, cannot be sold or transferred, may be revoked if obtained through fraud or abuse, and confer no ownership rights in anything.
  4. BidYourStartup is an entertainment and spectacle product. A purchase buys temporary placement and a public reign timer — not advertising results, traffic, endorsement, or any business outcome.
  5. Paid placement disclosure. Every position on BidYourStartup, including #1, exists because someone paid $1.99 for it. Listings are labeled as paid placements on the site. Nothing on BidYourStartup is an editorial ranking, review, or recommendation.

2. Who may use BidYourStartup

  1. You must be at least 18 years old to purchase a placement. By paying, you confirm you are 18 or older.
  2. No account is needed. You buy a placement directly; we associate your purchase with the contact email you supply (if any) and the payment confirmation from our processor.
  3. You warrant that you have the right to submit the name, URL, tagline, and logo you give us — for example, that you own them or are authorized to use them for the startup being promoted.

3. Acceptable use

  1. Do not impersonate. You may not submit a startup name, logo, or tagline that impersonates or is confusingly similar to an existing company, product, person, or public entity, or that you do not have the right to use.
  2. Do not submit content that infringes intellectual property, is unlawful, hateful, harassing, sexually explicit, promotes gambling, or contains malware or links to it.
  3. Do not manipulate the leaderboards: no automated purchasing, stolen cards, multi-account crown farming, velocity abuse, or other fraud. We reserve the platform right to remove listings and void reigns that result from abuse.
  4. One purchase equals one listing in the rotation. The price is fixed at $1.99 for everyone; there are no auctions, tiers, or boosts.
  5. Unreachable links. We accept submissions whose links are offline at the time of purchase. If a submitted link is unreachable, we display a visible “link unreachable” indicator next to the listing. Links that remain unreachable for 7 consecutive days may be delisted without notice in order to keep the board honest for visitors. Delisting a dead link is a housekeeping measure and does not entitle you to any refund under these Terms (see Section on refunds: all placements are final).

4. Your content; license grant

  1. You keep ownership of everything you submit (name, URL, tagline, logo). We claim no ownership of it.
  2. You grant us a worldwide, royalty-free, non-exclusive license to host, reproduce, display, and archive your submission on BidYourStartup — including on the site itself, screenshots used in BidYourStartup’s social-media promotion of the leaderboard, and permanent public archives such as the hall of fame and reign history.
  3. Submissions are public by design. Don’t submit anything you wouldn’t put on a billboard.
  4. You agree to indemnify and hold us harmless against claims arising from content you submit, including claims that it infringes someone else’s rights. If a claim lands on us because of your listing, it’s on you. [INDEMNITY-CAPSULE-REVIEW-TBD — counsel to finalize scope]

5. Moderation, removal, and termination

  1. We have absolute discretion to reject, remove, restore, disqualify, or annotate any listing or buyer at any time, for any reason or no reason — including suspected fraud, intellectual-property infringement, impersonation, or leaderboard manipulation. Paying does not guarantee display.
  2. If we reject a listing you paid for, we refund the $1.99 automatically. Rejection is not otherwise compensable.
  3. Removal obligations survive the end of a reign: hall-of-fame entries and archived pages remain subject to retroactive removal or annotation, and affected crowns may be recomputed.
  4. Repeat infringers — users who repeatedly submit content that draws valid infringement complaints — lose the ability to purchase placements, and their accounts/emails may be terminated and blocked.

6. Refunds; finality of displayed purchases

  1. If your listing was never displayed publicly due to our fault — because we rejected it in moderation, or a technical failure kept it from going live — you may request a refund of your $1.99; see our Refund Policy, which is part of these Terms.
  2. There will be NO refund if the website/business is listed successfully but replaced by another, EVEN AFTER ONE SECOND. Once your listing has been displayed at #1, the placement service has been delivered and the purchase is final — regardless of how briefly your reign lasted. Goodwill refunds remain possible at our sole discretion, but are discretionary-and-rare and never promised.
  3. No refund is owed where the underlying payment later fails, is reversed, or resulted from abuse patterns we detect; fraudulent reigns are void.
  4. Nothing in these Terms waives any non-waivable statutory consumer rights you may have under applicable law. [CONSUMER-RIGHTS-COUNSEL-REVIEW-TBD]

7. Service availability

  1. BidYourStartup is offered with no uptime guarantee. The site may be unavailable from time to time, including during scheduled maintenance windows, which we will try to keep brief.
  2. We may suspend access to the service for abuse, fraud, technical failures, or forces beyond our control. A suspension does not refund displayed, delivered placements; see our Refund Policy.

8. Disclaimers; liability

  1. BidYourStartup is provided “as is” and “as available” without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted availability or that reign timers, counters, and crowns will always compute perfectly; when they err, we fix them when we can.
  2. To the maximum extent permitted by law, our total liability to you for any claim relating to BidYourStartup is limited to the amount you paid us in the 12 months before the claim — in practice, $1.99 per placement. Neither party is liable to the other for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. [LIABILITY-CAP-COUNSEL-REVIEW-TBD]
  3. The limits in this section don’t apply where the law forbids limiting them, and nothing here limits liability for fraud or for anything else that can’t lawfully be limited.

9. Governing law and disputes

  1. These Terms are governed by the laws of Pakistan (founder's domicile; final jurisdiction confirmed at registration), without regard to conflict-of-law rules. Venue for any dispute lies in the courts of Pakistan (founder's domicile; final jurisdiction confirmed at registration).
  2. Before filing suit, email support@bidyourstartup.com and give us 30 days to try to work it out informally. Most $1.99 problems should not become court problems.

10. Changes to these Terms

  1. We may update these Terms from time to time. The current version lives at this URL with its effective date; changes apply to purchases made after the effective date.
  2. If a change materially reduces your rights, we’ll note it on the site for 30 days before it takes effect.
  3. If any clause here is found unenforceable, the rest stays in force, and the unenforceable clause gets replaced with the closest enforceable one. These Terms plus our Privacy Policy and Refund Policy form the entire agreement between you and us about BidYourStartup. We may assign this agreement in connection with a sale of the project.
